Legal Update: Smoking in Vehicles and Safety Helmets


 

Two changes in Health and Safety Legislation apply from the beginning of this month:

  • Smoking in Vehicles: it may be worth reminding your employees that it is now prohibited to smoke in a private vehicle in England where a child (someone under the age of 18) is present.
  • See the Smoke-free (Private Vehicles) Regulations 2015.
  • Safety Helmets – exemption for Sikhs: the exemption of turban-wearing Sikhs from wearing a safety helmet on construction sites has been extended to all workplace where a safety helmet may be required, including warehouses, factories and vehicles involved in transportation. There are some very limited exceptions where employers can require Sikhs to wear safety helmets.
  • This change was brought in via the Deregulation Act 2015.
